H&C Program
The Humanitarian and Compassionate (H&C) program is a Canadian immigration program that provides a pathway for individuals who are in Canada and may not meet the requirements of other immigration programs, but still face exceptional circumstances that warrant special consideration for permanent residency.
The H&C program is intended for individuals who would face undue hardship if they were to return to their home country, and who are unable to apply for other immigration programs due to their specific circumstances. Some examples of situations that may warrant consideration under the H&C program include:
- Family violence or abuse
- Health issues
- Risk of persecution or harm in their home country
- Best interest of a child
- Length of time spent in Canada.
- Community ties in Canada
To be eligible for the H&C program, individuals must be physically present in Canada at the time of the application and must demonstrate that they face exceptional and compelling circumstances that warrant special consideration for permanent residency. The decision to grant H&C consideration is at the discretion of the Immigration, Refugees and Citizenship Canada (IRCC) officer reviewing the application, and it is based on a case-by-case assessment of the individual’s circumstances.
