No More LMIAs for Foreign Workers? What are your options now ?

Har Amol Walia (RCIC) | August 27, 2024

In a recent announcement by Canadian Government, authorities have decided to put a cap on LMIAs. Starting September 26, no LMIAs will be approved in ‘low-wage’ category. This measure mainly strives to improve immigration and economic situation in Canada. Let’s understand this whole scenario and explore, what all options are now there for people looking to move to Canada.

What is a ‘Low-Wage’ LMIA?

Many a times it is assumed that labor-jobs are ‘low-wage’ jobs in Canada. However, this is not true. Any job that pays you less than $28/hr is a ‘low wage’ job. For example, if you are working as a Book-keeper on $25hr or as a Supervisor/Admin on $27/hr it will still fall in a ‘low wage’ category.

What is the situation right now ?

Due to influx of foreign workers and malpractices by few employers in Canada, government has come up with this move. As per this new measure, processing of low-wage Labour Market Impact Assessments (LMIAs) for Census Metropolitan Areas (CMAs) where the unemployment rate is 6% or higher is not possible any more. This measure is going to come into effect on 26th September 2024. These changes (LMIA related) have already come into effect in the region of Quebec.

What are the options available ?

Though government measures have become stricter in terms of LMIAs, there are still some sectors that are open where low -wage LMIA can be processed. These sectors are – primary agriculture, food processing, fish processing, construction, and healthcare. So, if you are a skilled worker there are better chances for you to get a closed work permit from an employer looking to hire experienced professionals.
