A Labour Market Impact Assessment (LMIA) is a document that Canadian employers must obtain from Employment and Social Development Canada (ESDC) before they can hire a foreign worker through certain immigration programs. The LMIA is designed to ensure that hiring a foreign worker will not have a negative impact on the Canadian labor market and that there are no Canadian citizens or permanent residents available to fill the job vacancy.
To obtain an LMIA, Canadian employers must demonstrate that they have made reasonable efforts to hire Canadian citizens or permanent residents for the job vacancy. They must also provide information about the job vacancy, such as the duties and responsibilities, wages and benefits, and the required qualifications and experience.
There are two types of LMIA: a positive LMIA and a negative LMIA.
A positive LMIA means that ESDC has determined that hiring a foreign worker for the job vacancy is necessary and will not have a negative impact on the Canadian labor market.
A negative LMIA means that ESDC has determined that hiring a foreign worker for the job vacancy is not necessary and that there are Canadian citizens or permanent residents available to fill the job vacancy.
